FWC approves gag, black grouper size limit; gag season changes

At its Feb. 10 meeting at the Florida Public Safety Institute near Tallahassee, the Florida Fish and Wildlife Conservation Commission (FWC) approved changes to the gag and black grouper minimum size limit and the gag grouper recreational season in Gulf state waters.
The approvals include:
Setting a 24-inch total length minimum size limit for recreational harvest of gag and black grouper in Gulf state waters
Setting a June 1 through Dec. 31 recreational season for gag grouper in all state waters of the Gulf excluding Franklin, Wakulla, Taylor and Jefferson counties (which have their own season from April 1-June 30) and excluding Monroe County (Monroe County follows the Atlantic state season)
These changes are similar to recent changes pending in Gulf federal waters. Gulf state waters are from shore to 9 nautical miles. Federal waters begin where state waters end and extend to 200 nautical miles.
These changes are expected to go into effect prior to June 1 recreational season opening and will be announced on MyFWC.com and via a press release.
Because gag and black grouper are commonly confused for one another, the size limit was increased for both species. These changes will mean that the size limit for gag and black grouper will be the same in both Gulf and Atlantic waters.
Prior to these changes, the Gulf gag grouper season was July 1 through Dec. 2 in federal waters and July 1 through Dec. 3 in most state waters. Opening the season in June will help reduce discards of gag grouper during the recreational red snapper season and the later December season closing will provide additional fishing opportunities for southwest Florida anglers who have expressed interest in being able to target gag during this time of year.

    The FWC release is purposely misleading, because of what they don't want you to know.

    "Franklin, Wakulla, Taylor and Jefferson counties (which have their own season from April 1-June 30)"

    The way it was written makes the reader think that Franklin, Wakulla, Taylor and Jefferson counties Gag Grouper season ends June 30, not exactly.

    It does end for Franklin, Wakulla, Taylor and Jefferson counties June 30 in Franklin, Wakulla, Taylor and Jefferson county state waters, BUT in effect anglers leaving from Franklin, Wakulla, Taylor and Jefferson counties can also harvest gags from July 1 to December 31 as long as they travel out of their state waters to other counties that can harvest gags in state waters from June 1 - December 31 and when they come back they can't stop in their state waters but they can still land gags from July 1 - December 31 at their dock in Franklin, Wakulla, Taylor and Jefferson counties.

    How politically convenient it is for the counties that are in close proximity to Tallahassee Franklin, Wakulla, Taylor and Jefferson counties get April, May and June in their state waters and then July, August, September, October, November and December in other county state waters as long as they don't stop in their states waters they can come to their dock in Franklin, Wakulla, Taylor and Jefferson counties.

    After the Franklin, Wakulla, Taylor and Jefferson counties April May and June gag harvest season is over Franklin, Wakulla, Taylor and Jefferson counties can still harvest gags in Federal water during the Federal Gag season as long as they don't stop in their closed state waters they can land gags at their dock in Franklin, Wakulla, Taylor and Jefferson counties.

    So in effect, the counties in close proximity to Tallahassee Franklin, Wakulla, Taylor and Jefferson counties can gag harvest more months than the rest of the counties on the west coast of Florida.

    The FWC created a loophole in the gag regulation that they don't mention in their press release.

    So gag and black grouper min length is 24 inches and is open in state waters from June 1 to Dec 31 but when is the season in federal waters?
