Flying a Diver Flag while Fishing - Really?

I was out yesterday and motored up to the Humming Bird wreck, I noticed one boat that had drifted off it by a bit, and he had a diver flag up... and lines in the water.. :huh I motor up to the beginning of the drift and drop lines. He then motors up to me, I ask if he's got divers in the water, then says, "No, but i'm glad I didn't". Seriously, first you pull shady crap trying to keep people off public numbers then give me attitude?!:nono I ignored him and kept on fishing.. The nerve of people. Sorry had to vent a little.

    That's about as frustrating as people that roll down the highway with their emergency flashers on which is also illegal

    I had no idea flying a diver flag with no divers in the water was illegal. I though it was really crappy etiquette, good to know. As far as approaching you need to keep a distance of at least 300 + ft from a diver flag right?

    (7) The divers-down flag must be lowered once all divers are aboard or ashore. No person may operate any vessel displaying a divers-down flag unless the vessel has one or more divers in the water.

    Under state law, boaters must make reasonable efforts to stay 300 feet away from divers-down flags in open water and 100 feet away in rivers, inlets, and navigation channels. Boaters approaching flags closer than these distances must slow their boat to idle speed, or the minimum speed necessary to maintain forward motion and maneuverability.

    Saw him at 8a Saturday afternoon flying the dive flag right in the middle of the Armada of boats. We called him out, but he just shrugged his shoulders.

    Pretty scummy. It was a beige-yellowish center console boat, looked about 26-30ft. Looked newer, can't remember the make though.

    I agree...in todays world of social media...take the pic and make him a pariah.

    He should be very embarrassed...but it may not have any effect.

    The Marina Patrol? I haven't heard that name used in ages. LOL! Now they are the FWC and are more worried about getting their shift over and not be late to their $25hr+ off-duty engagements for the DOT. Park truck in front of construction area. Turn on lights. Go to sleep for 6 to 7 hours. Wakeup and go home for a bit and repeat almost daily.

    When you have to show an FWC officer the kind of fish you caught in their own book its pretty sad. Caught an 8 pound gator trout that an FWC officer said was an out of season snook and almost got arrested for me telling him it wasn't a snook over and over again and I shouldn't be sighted for an illegal fish. Then after showing him in his own fisheries book snook don't have teeth I was final let go almost 45 minutes later.

    I would personally like to the marine patrol back on duty and not on off-duty details.

    I was anchored today in 90' off Sebastian and had a boatload of divers pull within 20 yds and throw out their marker buoy and proceed to jump in. I had to leave so I didn't yell at them. It I pulled up on them to fish, they would have cried for days.

    Snag hooks work great clearing our divers from a fishing hole. If you were there first just get it on video.

    Yes, you are right. Cited not Sighted. Must be that these MAC's thAT auto correct everything or I really don't care to proof read my posts.

    Your other options is to troll thru said divers with your grappling anchor and see if you get a bite. LOL Just let it hit the bottom. Let out a 100ft or so and put he boat in gear.

    I've seen guys use this method to clear out lines so bait could be netted after being hit by weight far from the pier. This was in summer only when you see no fish and non(mis-spledded?) would be caught off the pier anyways in the flat calm crystal water and the bait was close enough to the pier that the boats could be hit with weights. One boat goes in close enough so all the guys use their long surf rods with only 8oz sinkers tide on and no hooks to try and hit the boats. The second boat heads close to the beach and throws out said grappling anchor and runs closely around the pier snagging all the lines and heads for the horizon while the second boat runs in quickly and nets bait.

    Notice - I haven't done this but certain boats had special anchors for this but have watched boats do it with only one boat or two boats.

    Yes I've had the boat hit by weights. We always tried to come in on the side of the pier and ask for one throw and we would leave. If we didn't get them we would leave. People with nice boats don't want to get hooked or their gel coat nicked up.

    I miss the old old days of fishing in SE FL.

    It would be really fun to do this at SI. Those guys chucking buck tails off the south jetty on 10 foot rods are brutal.
