  Yes. I have read about people being arrested for BUI in a canoe and a kayak. You probably already know that you can get a DUI on a bicycle and kayaks are kind of like the bicycles of the water in that they are small, slow and self propelled. Believe it or not, people in Florida have actually been arrested for DUI while rollerblading. Operating intoxicated anything that the state can refer to as a vehicle can get you charged with DUI.
  If you are not totally drunk or in a heavily congested area causing problems, you probably won't get in trouble for drinking some. Lots of people take a few beers in their kayak. But yes, they can get you for it if they want.

  Of course, this is Florida...you can get arrested for intent to operate a kayak while under the influence.
