A smart cops tells them to turn off the audio recording... The video is legal.. unauthorized voice recording is the violation. The very basic skill of an LEO is maintaining one's composure in all circumstances. LVPD will write this fajjet a nice check.

Help me out with this, not saying you are right or wrong, but taking a video in a public place or even private property, I am not so sure audio is not legal. I agree there are times when recording what someone is saying, like on the phone, is illegal but show me where you come by when taking a video in public the accompanying audio is illegal. I really don't know, but that doesn't seem to make sense. I have seen hundreds of videos like this one with audio and never seen a word about the audio not being legal. Using that logic it would be almost imposable to video anything without having permission from anyone who might be recorded on audio.
I do agree that this guy is probably and "ambulance chaser" in that he tries to get into these situations. That said the cop should not have taken his bait and just let him go about his business instead of beating him up and arresting him (can't really argue that according to the outcome finding the cop at fault).
the ACLU disagreed.
"It's not that recording any conversation is illegal without consent. It's that recording a private conversation is illegal without consent," he said. "So then the question is, 'Are the words of a police officer spoken on duty, in uniform, in public a 'private conversation.' And every court that has ever considered that question has said that they are not."

It is not a new trick, and the giveaway verbiage should have tipped off this Cop.. 'I am perfectly within my rights to videotape this area..' ( A-HA, Copernicus !! Methinks this dude might be fishing for a lawsuit...) But No. The Cop bit the hook and took this crybaby down. Now he gets dragged in the dirt for 2 years. Stupid. There are several variations to this theme: A chase van with video for traffic stops on the decoy; a parked car with camera, and decoy on the sidewalk shooting birds at passing cops..
It's a different kind of fishing.
When we smelled these guys, we would try to identify them, get their tag numbers, then drive off. They really carry on when the LEO walks away from them. Then, they become another intelligence bulletin.

It seems everyone is making a decision based on a video that is nothing but a guy over acting.
I know the investigation shows there were policy violations, so the cop did some things wrong. But from what I heard on the video, I agree with Triplewrap, the guy was just looking to bait a cop. Too bad the cop fell for it.
