Sexual Harassment

amighoamigho Posts: 776 Officer
Had a situation @ work yesterday, a female coworker made a sexual harassment innuendo to a male co-worker, I'm confused as to which scenario is correct?!

Scenario #1: Male worker talks to another male buddy and just as guys talk, #1 says to the other "Hey Bob, Jane sure has a nice body, oh the things I'd like to do" Bob laughs, nobody else hears the conversation.

Scenario #2: "Hey Jane, you have a bangin' body, you wanna get naked and do stuff with me" directly to Janes face.

Scenario #3: Jane HEARS from Bob (obviously a backstabbing POS) that private conversation between the friend where nobody else was around, gets pissed and threatens sexual harassment because of what she was told but not privy to hear first hand.

Opinions please, and no...there are no pix of Jane as she is not real.

Scenario #2 is probably a violation of policy. Scenarios #1 and #3 are probably not a violation of policy as long as there is no evidence (recordings, eye witness testimony) the conversations took place.

Easy. Never ever try to handle a sexual harassment issue yourself. You aren't trained for it. Hand it off to HR immediately.

this is the mentality that makes OT into the problem child of the FS forum, this is off topic-anything not fishing-there are times when you have to put on your big boy panties and act like an adult.

Your question is unclear. Are you asking which of the three would qualify as sexual harassment for lawsuit purposes or which is inappropriate for workplace behavior? How do those three scenarios relate to the sexual innuendo referenced in the first paragraph?

Heres how our HR would handle it...

To the men- pack your thigns, your no longer needed. Our lawyer will probaly be contacting you shortly.

To the woman- take the rest of the week off, with pay. See you on Monday. Please dont sue us. We will have your new office ready Sunday night.

We actually had 2 guys get fired because of hearsay, from a conversation that was held outside of work, similar in context to the OP converation. Another incident got a guy sent home for a week with he got burnt by molten metal- he was cussing, understandaby IMO. One of the receptionist heard him while she was out smoking in the machine shop, where the burn victim works.

The best answer I can give you is to not have any of your three scenarios.

Lets determine if Jane has a banging body and is purdy. If she don't there's no case here...

Step on her foot and get her to smack you... You can then soo her for being so damed ugly...

If she's hot the dude she was commenting on should nail her. I miss "harassing" the crap out of girl students they would hire for my department at UF. Oh wait, no I don't one of them I married.

Thing with these issues is that it does not matter what is actually said, only how the offended party thinks about what was said.
