Minimum skill requirements for a child to legally take a lobster limit.

TeamTekeTeamTeke Posts: 993 Officer
For mini season this year we will have my grand-daughter on the boat. If she is unable to dive for bugs what other skills would allow her to keep a personal limit. e.g.- remeasuring lobster a second time, assisting divers with gear.
keeping an accurate count of the harvest etc.

The law state that the limit is 6 lobsters per harvester and you cannot harvest say 10 while your buddy harvests 2. If you team up and take turns chasing them into the net that counts as harvesting. Measuring and counting don't "count" as harvesting.

If the FWC boards you and you tell them that you harvested 12 and your granddaughter harvested zero then they could ticket you if she is one of the folks that is considered a harvester for your limit numbers. Something like that happened on one of the TV shows showing FWC in action where someone on the boat told the FWC officer that they did not go in the water and harvest lobsters. The officer wrote up a ticket.

Lobstercatcher229- I would still like to receive comment from an FWC source. Can you site a code reference, so I may read and understand it properly. - Thanks

My forum buddies and I had an interesting discussion on this subject sometime in the past. A quick search couldn't find it. Sorry that this thread seems to be attracting crickets.

I find it interesting that the law changed from "person" to harvester. Sorry that I can't give you chapter and verse of what is "harvesting" right now.

No crickets on this forum page....the Florida Administrative Code (FAC) regarding "Harvest" in regards to Spiny Lobster can be found under 68B-24.002 (6). Harvest means the taking or catching of spiny lobster by any means whatsoever......under Florida law you have to be a legal harvester to retain a legal limit.....meaning you have to take or catch...... Team Teke....not sure the age of your grand daughter but I would be hesitant to retain a limit for her (or in her name) with the way the law is written....by the way I'm not an FWC Officer, but I am a marine enforcement officer in this state and the agency I am employed by actively enforces the wildlife laws in regards to saltwater fisheries.

Its not a boat limit. The limit is based on who catches not how many grandkids you can squeeze on the boat.

I routinely thank those who check me. I have followed the rules for many years and appreciate that I have consistently found lobsters. I know that if no enforcement happened then I would catch no lobsters. So thank you, Westwall, for helping to make it so that I and others can go out and legally catch lobsters and other sea creatures.
