Armed shopper shoots at Walmart shoplifter, police say

ORANGE CITY, Fla. -
Gunfire erupted in the parking lot of an Orange City Walmart store on Wednesday when an armed shopper fired shots at a suspected shoplifter, police said.
It started as a shoplifting incident inside the store on Veterans Memorial Parkway near Saxon Boulevard. A thief loaded up a cart of merchandise, and loss-prevention employees tried to stop him as he left the store, officials said.
Authorities said the shoplifter, identified as Eddie McKee, 42, knocked Ann Buongiorno to the ground as he ran out of the store.
"I'm all still shaken up from all this," said Buongiorno. "I thought I was going to die. I was knocked down very hard, and I thought I got shot, and I was screaming at the top of my lungs."
An off-duty law enforcement officer saw McKee running for his car and ordered him to stop, but McKee fled.
Investigators said another man in the parking lot, who was identified as Jose Martinez, pulled out a gun and fired at least four shots at McKee. The back window of the car was shot out, and bullet holes were found in the trunk.
Martinez told authorities he was trying to mark McKee's car, but officials said bullets landed inches away from the cars of bystanders.
"I just thank God that he protected us," Buongiorno said.
"There was no one in danger," Martinez said.
"There is a gray sports car in Orange City on Veterans Memorial Parkway, and it has got the windshield in the back blown out, and it looks like he is running from something," said a 911 caller.
One customer was with her daughter when the shots were fired. She told the dispatcher she was calling 911 from inside her car.
"One (man) drew a gun, opened the guy's car door, yelled, 'Freeze! Freeze!' and then fired shots," she told the dispatcher.
Buongiorno's husband said he thinks the citizen had a right to shoot.
"He came at us," said Andrew Buongiorno. "(He) threw the car in reverse, tried to run us over. That's attempted murder."
No one was shot.
There were minor injuries to two people from the store, including the woman who was pushed down, according to authorities. The shooter was taken to a hospital with some type of injury.
McKee was stopped near South Kepler Road and East New York Avenue in DeLand, authorities said. He faces a misdemeanor charge.
Investigators said Martinez was charged with two felonies, but he does have a concealed weapons permit.

A Deltona man shopping at a Walmart was arrested for shooting a shoplifter's car Wednesday, saying he wanted to mark the vehicle so police could find it, police said.
Jose Manuel Martinez, 35, was charged with aggravated assault and shooting into an occupied vehicle, said Orange City police Cmdr. Jason Sampsell.
About 12:37 p.m., the suspected shoplifter, Eddie Mckee, 42, of DeLand, started stacking steaks and ribs into a shopping cart at Walmart, 2400 Veterans Memorial Parkway, Orange City. He then tried to leave the store without paying for more than $200 worth of meats, Sampsell said.
When a Walmart loss prevention officer tried to stop McKee, the suspect abandoned his shopping cart and ran out of the store, pushing down a woman on his way out, Sampsell said.
"As Eddie Mckee was running out of the store being chased, Jose Manuel Martinez also chased after him," Sampsell said.
Martinez said he didn't know why McKee was being chased but he joined in. And when he could not stop Mckee who entered his car to get away, Martinez pulled out his 9 mm handgun, Sampsell said.
"He fired at the car a minimum of four times," Sampsell said. "He said he didn't want to kill the suspected shoplifter but wanted to mark the car for police."
Martinez, who has a concealed weapons license, was not justified opening fire in a busy shopping parking lot in the middle of the day, Sampsell said.
"His life was not in immediate danger so he was not in fear for his life nor was he trying to defend someone else whose life is being threatened," Sampsell said. "There was no justification for the shooting."

Or he could have just stayed out of his way, gotten a tag number and discription of the vehicle and perp, called 911, let LE know what direction he was headed.
Instead the shoplifter will me out in an hour on a misdemeanor charge of stealing a candy bar and the shooter may be going to prison.
It's a good thing no one was shot or this kids life would be over as he knows it.
