Alright guys the IRON IS HOT!! the Times union and local news has finally given some coverage and we as a group need to pursue with great effort a course to get the Magnuson -Stevens Act changed or at the least have our representatives push on the bill H.R. 3307 introduced by Andrew Crenshaw. The following is an exert from an e-mail I received from him 8/28/09
"Additionally, you might be interested to know that I recently joined several of my colleagues in introducing legislation, H.R. 3307. This legislative initiative directs the Secretary of Commerce to conduct a study of the red snapper in the South Atlantic fishery and to delay implementing an interim rule until the data from the new study can be utilized.
I am confident that the interests of the Department of Commercein managing our fisheries and my interest in saving jobs and revenue in the state of Florida are not mutually exclusive. I support seeking a resolution that will fulfill both the requirements of the Magnuson-Stevens Act, as well as sustain the fishing industry in Florida."
Unless we as a whole ( I mean Florida) rally up and continue the fight against the use of bad data and the laws which are forcing the implementation of draconian regulations on our fishery we will at some point be banned from every species in our offshore fishery. If this is allowed to happen with the red snapper the next plan by the council will have to be that to much pressure has been put on the pelagic species (by the way Pelagics are on the councils next agenda check it out) because of the ban on vertical fishing due to the red snapper being over fished.
Lets keep the presure on our local government,State,and Federal. I would be inclined to pursue another boat float on the weekend when more people could partisapate. Would there be any interest in this?

Congratulations on your efforts so far. It looks like you are making a difference. I have a lot of experience organizing things and my advice to you is to schedule your activities as far as ahead as reasonably appropriate and to communicate, communicate, communicate. Use every source available to you including FS Forum, local fishing clubs, newspaper editors(Jim Sutton), other internet websites such as The Hull Truth, Dammitman, etc. Your point of economic damage is accurate, IMHO, so find those that will be damaged and get them involved. Fuel companies, local tackle shops, boat dealerships, truck dealerships, clothing companies(Aftco, Guy Harvey,etc) and anyone else that will be damaged. It is in their economic interest to help you. Spread the word beyond just our local market.
You're doing a great job, spread the word far and wide and if the boat float is your intention, get the word out and have people tell their friends who should tell their friends and on and on.

Thats awesome. This is a HUGE breath of fresh air to know that we actually can make a difference, but the war is STILL not over. A boat float on the weekend would be fun.
FYI, Congresswoman Corrine Brown has signed on as a co-sponsor to H.R. 3307. So she has been listening as well. It is my understanding that if HR3307 does not go through the entire legislative process during this session of Congress, then it will have to be re-introduced again next year.

OK guys update from Lisa Rinaman Policy Director for the mayors office called me today to let me know where the city is on the snapper closure issues. They took my advice and had a representative at the public hearing and with a little research have concluded that our concerns are also a city concern and they are drafting a letter of resolution to the SAFMC with the cities concerns and are also requesting from the cities legal department input as to how to address this federal issue as it will effect the economics of our community. Our local representatives will be contacted by the city to also push for resolution in this matter at a federal level. Our city council members are also calling and e-mailing the city voicing concerns Lisa told me.
Just goes to show you even one squeaky wheel can make a difference. Imagine if we all got behind the city on this. Like I said the Iron is hot show Lisa in the city that we are in support of their efforts give her a call and talk to your city council members. Remember do not beat them up just voice your concerns on the fact that these regulations will effect our community economically.

I had all her "constituants" email her from my computer here at work.....we told her that the ocean they want to close has her whitings in it.....and if we can't fish in the ocean, then no more whitings, figured that'd get her attention.

Ok guys latest up date from the city council attached is an e-mail with directions to help our cause I suggest we take advantage of this. Lets follow Johns suggestions and make it happen. I contacted Dennis Young tonight and he is going to work his contacts and if you have relatives along the coast from here south or north let them know to contact the city councils and mayors to inform them of Jacksonville's city government's position and that we need all cities to join in we have one city on board and should be easier to get the rest to follow suite. I will post up the Bill number to include with your e-mails to the city council as soon as John sends it to me. Remember our mission is to give support to the city councils and mayors efforts in this matter so let them know. I would like to get a very,very,very large group to show up Tuesday to get this passed as an emergency resolution. Telling NOAA and the SAFMC that our local city government is also behind us.It will not be something they expected cause I feel NOAA and SAFMC are use to no one taking the fight to the next level.

Attached is a resolution I have introduced for consideration by the entire City Council. The resolution should appear (as a new introduction) on the City Council agenda at Tuesday night’s meeting. I expect to have a bill number assigned to the resolution sometime tomorrow, and will forward you the number as soon as I receive it.
Unfortunately, the normal legislative process will not bring the resolution to a vote (by the full City Council) until December 8, 2009. However, as I understand it, voting on December 8th would be well after the public comment period had ended for proposed South Atlantic Fishery Management Council amendments 17A, 17B and 18. With that said, the only way to have the resolution become part of the South Atlantic Fishery Management Council public comment record would be for the City Council to consider it as an emergency Tuesday night. While certainly possible, consideration as an emergency would be greatly enhanced if you (and others interested in this issue) did the following;
· Contact other City Council members urging them to sponsor, support and/or consider the resolution as an emergency. (When contacting City Council members, the bill number will make it easier for you to reference the resolution.)
· Attend Tuesday’s City Council meeting to address the City Council during the public comment period (around 6:00 PM) urging City Council members to sponsor, support and/or consider the resolution as an emergency.
It is also my understanding that Mayor Peyton intends to send a letter to the South Atlantic Fishery Management Council with language similar to that found in Section 1 of my resolution.
Again, I’ll provide you with a bill number as soon as I have the same. If you should have any questions, please contact me accordingly.

A RESOLUTION URGING THE SOUTH ATLANTIC FISHERY MANAGEMENT COUNCIL TO REFRAIN FROM ADOPTING REGULATION AMENDMENTS THAT WOULD HAVE THE EFFECT OF IMPOSING DRASTIC RESTRICTIONS ON SNAPPER-GROUPER FISHING IN FEDERAL WATERS OFF THE FLORIDA COAST BASED ON INCOMPLETE OR INSUFFICIENT SCIENTIFIC INFORMATION; DIRECTING THE CHIEF OF LEGISLATIVE SERVICES TO FORWARD A COPY OF THIS RESOLUTION TO THE SOUTH ATLANTIC FISHERY MANAGEMENT COUNCIL; PROVIDING AN EFFECTIVE DATE.
WHEREAS, the South Atlantic Fishery Management Council has proposed several amendments to coastal fishing regulations that would have the effect of drastically curtailing, if not entirely eliminating, fishing for red snapper, grouper, tilefish, sea bass, and other deepwater fish for a period of many years in order to combat overfishing and depletion of fish stocks; and
WHEREAS, the fishing industry is an important one to Florida’s economy and the fish caught by that industry are an important part of Florida’s overall food chain and a vital component of the state’s restaurant and tourism industries which provide employment and economic support for hundreds of thousands of workers; and
WHEREAS, while the protection of sustainable fisheries and fish populations is undoubtedly an important function and a national priority, the regulatory means to these important ends should be based on the best available scientific data and a true understanding of the actual conditions of the fish populations, their overall abundance, reproductive rates, average lifespan, and other factors that determine the sustainability of fish stocks; and
WHEREAS, legitimate questions have been raised by numerous parties about the quality and sufficiency of the data upon which the current proposed regulations are based, and these questions should be resolved to the greatest extent possible by unbiased parties and good quality, peer reviewed science before drastic regulations are implemented that would affect the economic livelihood and quality of life of tens of thousands of Florida’s citizens; now therefore
BE IT RESOLVED by the Council of the City of Jacksonville:
Section 1. That the City of Jacksonville hereby urges the South Atlantic Fishery Management Council to refrain from adopting regulatory amendments that would have the effect of imposing drastic restrictions on snapper-grouper fishing in federal waters off the Florida coast based on incomplete or insufficient scientific information, and urges the Council to commission unbiased experts to assemble the best quality relevant data to determine what regulations are merited to meet the goal of sustainable fisheries.
Section 2. The City Council hereby directs the Council’s Chief of Legislative Services to forward a copy of this adopted resolution to the Chair and the Executive Director of the South Atlantic Fishery Management Council in North Charleston, South Carolina.
Section 3. Effective Date. This Resolution shall become effective upon signature by the Mayor or upon becoming effective without the Mayor's signature.

Got this response from Mac Currin when I sent an email to the SAMFC. He appears to be address my comment that perhaps comemrcial and recreational fisherman should adhere to the same limits and regulation (sorry to any of you commercial guys out there). I think we need to bombard this guy with more emails. I replied, everybody else should too.

the commercial industry once caused the greatest mortality of red snapper,
recently, the recreational fishery is responsible for the greatest
proportion of red snapper mortality. The current fishery is what the
council must deal with and manage, so measures to reduce mortality must also
include the recreational fishery.

There appear to have been a number of other emails sent to City Council members (in the past few days) supporting the approval of my resolution (2009-920) as an emergency at our meeting Tuesday night. The resolution opposes the SAFMC’s proposal to implement fishing bans on snapper, grouper and other species, and addresses the fact that the data being used by the SAFMC is questionable at best.
Because the public comment period for the SAFMC amendments (17A, 17B and 18) ends on Wednesday, November 25, 2009, it is imperative that the City Council approve the resolution as an emergency Tuesday night if it is to be included as part of their record. I would encourage you to consider attending Tuesday’s City Council meeting to voice your support of 2009-920 during the public comment period – which normally begins around 6 PM.

I am writing you about the proposed red snapper closures in regards to the economy of our great State of Florida. I am a life long residence of Jacksonville Florida and recreational fisherman as was my grandfather,father,and my two children.
You are probably aware of the proposals by NOAA and the South Atlantic Fishery Management Council which intend to virtually close vast areas of our fishery off our East coast for recreational and commercial fishing. These proposed regulation are the most drastic in the history of fishery management and will drastically effect our coastal communities socially and economically.
The Mayor of Jacksonville has taken a position on the proposals as well as our city council and have drafted a letter of resolution to be voted on in an emergency vote Tuesday Nov. 23 2009. The proposed resolution is as follows:

It is my request and numerous other recreational anglers and commercial fishers that our State government take issue with these Federal proposed regulations which will have a major impact on our local economy. Several of your colleagues have also taken issue with the questionable data by NOAA and the SAFMC research on the stock assessments of our snapper fishery and have been diligently trying to halt the efforts of the SAFMC to close the whole fishery from N.C. to the southern Keys till better science can be used for a more accurate assessment. The State of Florida is the fishing capital of the world and deserves the use of accurate data in it's fishery management not just the best available. The integrity of the SAFMC and NOAA is highly suspicious
I suggest several changes to the current system of fishery management:
1. Members of the SAFMC should be elected not nominated (the chance of non bias decision making is removed and the people of the State are represented with integrity).
2. NOAA should not be allowed to be a voting member of the SAFMC.
3. The State representatives on the council should represent three divisions with a member each 1)recreational, 2)commercial, 3)governmental
4. Any Federal regulation impacting the local coastal communities should be required to pass a State Federal regulation review board made up with a representative of each coastal community effected.
5. Independent State represented peer review of all fishery stock assessments prior to the rubber stamping of the stock tagged as over fished.
There are several other options that may also be considered in this process and should be addressed.
In conclusion I would hope that you would review the information provided and join with the City of Jacksonville in this Resolution 2009-920 and the State consider a resolution position in support of requiring better science to manage our fisheries.

Henry Brown R-SC is the only sponsor of HR #3307, who is also member of the HCNR. Mr. Brown is also the ranking Republican on the Subcommittee.
And also the following comment from the HR #3307 website: “…if your Member of Congress does not sit on any committee relevant to this bill, you generally have no opportunity to voice your opinion on the bill while the bill is receiving its most important consideration.”
Although, we have no members of congress from Florida sitting on this very important committee, maybe we can sway the other members to report HR #3307 out with favorable recommendations.....
